Judge rejects Ghislaine Maxwell bid to vacate sex-trafficking conviction

A New York federal judge called Maxwell’s habeas petition meritless, said Epstein-file material incriminates her, and warned that a further appeal would not be taken in good faith.

U.S. District Judge Paul Engelmayer denied Ghislaine Maxwell’s pro se habeas petition seeking to vacate her 2021 sex-trafficking conviction and 20-year sentence. In a 67-page ruling made public Tuesday, he called the claims meritless and almost all frivolous, said nearly all were procedurally barred, and wrote that Epstein Files Transparency Act material, where relevant, incriminates her. Maxwell is at a prison camp in Bryan, Texas, after a transfer that followed an interview with Todd Blanche. She has sought a pardon from President Trump, who has not committed to one.

Shared facts

The judge rejected all of Maxwell’s claims.

He wrote that the petition’s claims are demonstrably meritless and generally based on speculation, distortions, and/or outright falsehoods.

Engelmayer said her arguments all or almost all are frivolous.

The judge called the petition lengthy, rambling and meritless.

She was sentenced to 20 years the following year.

Maxwell argued EFTA evidence showed she was not given a fair trial.

Maxwell filed the habeas petition in December 2025.

Engelmayer said further efforts to appeal would be in bad faith.

The petition was self-filed.

She was convicted of sex trafficking in December 2021.

The order was 67 pages.

He wrote that relevant material incriminates her or reinforces the rulings she challenges.

He said she presented nothing that could upend the trial outcome.

A jury convicted Maxwell in December 2021 on five felonies, including sex trafficking of a minor.

The judge noted many of her “new evidence” claims stem from documents released under the Epstein Files Transparency Act.

Engelmayer said she could have raised the selective-prosecution claim on appeal, and he found it frivolous anyway.

She claimed some of that evidence had been withheld from her at trial.

The judge wrote that abundant admissible evidence established Maxwell’s knowing participation in enabling Epstein’s crimes.

She claimed constitutional and legal errors had deprived her of a fair trial.

Congress passed the Epstein Files Transparency Act in November 2025.

Maxwell is serving her sentence at a federal prison camp in Bryan, Texas.

The judge wrote that the purported new EFTA evidence is largely irrelevant and does not support her claims of error.

She renewed an argument of juror misconduct at her 2021 trial.

The Supreme Court declined to hear her appeal in October 2025.

She was moved one week after she met in person with then-Deputy Attorney General Todd Blanche.

Maxwell had been moved from a Tallahassee federal women’s facility to a lower-security prison camp in Bryan, Texas.

Maxwell’s lawyer indicated she was angling for a Trump pardon.

Under bipartisan congressional pressure, the administration released millions of Epstein-related documents, videos and images.

The jury found she recruited girls and young women to be sex trafficked and abused for about a decade starting in 1994.

Blanche was recently confirmed by the Senate as U.S. attorney general.

Blanche is President Trump’s former personal lawyer.

Epstein was found dead in a New York federal jail in August 2019 and his death was ruled a suicide.

Maxwell and Epstein had associated with Trump in the 1990s and early 2000s.

Trump has not ruled out a pardon.

Maxwell appeared virtually before House Oversight in February and pleaded the Fifth, refusing to answer questions.

Trump said he did not know anything about it and would speak to the Justice Department.
