Judge Deborah Boardman enjoined the August executive order aimed at birth tourism and other carveouts, citing the Supreme Court’s June ruling in Trump v. Barbara.

U.S. District Judge Deborah Boardman in Greenbelt, Maryland, issued a preliminary injunction on Sept. 2 blocking enforcement of President Trump’s August 2026 executive order that sought to deny birthright citizenship in cases of birth tourism, “alien enemies,” and related categories. Boardman, a Biden appointee, said the Supreme Court’s June decision in Trump v. Barbara already held that children in the certified class are citizens at birth. The White House called her an activist judge.

Blanche said the administration will keep fighting and will return to the Supreme Court if needed.

The Justice Department argued the new order does not conflict with Barbara because it was designed around narrow exceptions the Court left open.

Former Justice Department official Abhi Kambli said Boardman was speculating on how the administration could incorrectly bar someone from citizenship based on a foreign terrorist organization.

Kambli told Fox News Digital that the ruling falls short because it is a facial challenge to the entire executive order.

Kambli said a facial challenge must show the order is unlawful in all of its applications, not just borderline cases.

Kambli said Boardman bought into plaintiff speculation that the government might get Tren de Aragua designations wrong and that is why the order should be barred.

Kambli said Boardman did not want to wade into whether that fits as an exception generally within Trump v. Barbara.

Shana Khader, legal director at We Are CASA, said the Trump administration has lost before this court, lost before the Supreme Court, and lost again today.

Khader said the White House will not succeed in stripping children of citizenship, evading binding court decisions, or placing an anti-immigrant agenda above the Constitution.

Monica said the threat to birthright citizenship is still out there.

Monica said she will keep fighting for permanent protection for her child and every child born in this country.

Khader said CASA is proud to continue the fight alongside families who have endured more than a year of fear and still refuse to surrender their children’s constitutional rights.
